§1 Organiser

The organiser of this competition is Carado GmbH, Bahnhof 11, 88299 Leutkirch im Allgäu (hereinafter referred to as "CARADO").

§ 2 Subject matter

These conditions of participation regulate participation in CARADO's Instagram timeline competition. The collection and use of the data collected or communicated by participants as part of the competition is based on the regulations on data protection (see § 2.12). By entering the competition, participants accept these terms and conditions.

§3 Eligibility

Persons who are resident in the EU, the United Kingdom and Switzerland and who are at least 18 years of age at the time of entry are eligible to enter. Employees of CARADO and their relatives and all persons involved in the competition, in particular those involved in the design and implementation of this competition, are not eligible to enter. Employees (and their immediate family members) of the Organiser and the agencies involved in this competition are not eligible to enter. The term "immediate family members" includes all of the following: Spouse, common-law spouse, children or stepchildren (whether natural or by adoption), parents, stepparents, grandparents, step-grandparents, siblings, stepsiblings.

§4 Participation

There will be a raffle for an E-scooter on the Carado Instagram-Account (https://www.instagram.com/carado_official/).  

The competition will start on Saturday, 03.04.2021 at 09:00 with an announcement posting and will end on Monday, 05.04.2021 at 24:00 CET ("the competition period"). The price draw and the announcement of winner will take place on Tuesday 06.04.2021.

The announcement of the winner will be made on the CARADO account under the relevant Instagram post. The winner will be contacted by CARADO via Instagram Direct Messenger on 06.04.2021 and tagged in the Instagram Story by Carado. 

The conditions for participation are the following:

1. you must follow the Carado page (https://www.instagram.com/carado_official/).
2. you must "Like" (thumbs up emoji) the corresponding Easter post (https://www.instagram.com/carado_official/).
3. you have to share our Easer-competition post in your own Instagram-story 
4. optionally, you can tag a friend who would also be happy to win the E-scooter.

Comments are excluded from participation,

• that are insulting, derogatory or discriminatory.
• which glorify violence, are xenophobic, pornographic or racist.
• with political content.
• with advertising messages.
• which are otherwise illegal or violate the rights of third parties.

Entries for participation in the competition may not contain false facts or violations of competition, trademark or copyright law.

The prize will be drawn at chance from among all comments that comply with the conditions and are received by the end of the promotion.

The winner will receive an Instagram Direct Message from CARADO and will be announced also in a story by tagging. The winner must then contact CARADO within one week of being notified of the prize via Instagram Direct Message and provide a valid postal address. The prize will be handed over as described in §6 as soon as the Promoter has received the winner's contact details.

If the winner does not respond within one week of notification, the prize will not be awarded. If the contact details provided are incorrect, the Promoter is not obliged to find out the correct addresses. Any disadvantages resulting from the provision of incorrect contact details will be borne by the participant. If the prize cannot be handed over for reasons for which the winner is responsible, the claim to the prize shall lapse. Cash payment of the winnings is not possible. Winning claims are not transferable. 

Participation is free of charge and independent of the purchase of CARADO products or services. Participation in the competition is only possible under the conditions of participation listed here. In the event of a win, participation in the competition includes consent to the mention of the first name and the first letter of the surname together with the place of residence in the CARADO social media channels, e.g. Instagram. Entries received after the closing date will not be considered in the draw, regardless of the reason for the delay. CARADO cannot be held responsible for any technical malfunctions, in particular network, electronic or computer failures.
 

§5 Exclusion from participation

Irrespective of any further rights, the organiser, as the promoter, is in any case entitled to take the following measures if there is reason to believe that a participant is violating applicable law, the rights of third parties, the provisions of these conditions of participation or the rules of the game:

• Deletion and / or blocking of the content provided and / or
• exclusion of the participant with immediate effect and / or
• subsequent disqualification and reclaiming of prizes. The organiser, as the holder of the right to take action, also has this right in the event of other manipulations by the participants.

Furthermore, the organiser is entitled to cancel, terminate or suspend the competition as a whole or on a participant-specific basis if

• promotion guidelines of Instagram are changed during the execution so that an execution is not possible according to the valid regulations of Instagram, or if the competition is stopped by Instagram.
• an attempt at abuse through manipulation is detected.
• proper implementation is no longer guaranteed, in particular in the event of hardware or software failure, program errors, computer viruses or unauthorised intervention by third parties.

§6 Prize

The prize will be drawn at random from all comments under the relevant Easter competition post that meet the conditions and are received by the end of the promotion. An E-Scooter will be raffled. 

The legal process is excluded. The prize will only be sent over by post. Cash payment or offsetting with other promotions as well as transfer to another person is not possible.

§7 Data protection

Insofar as personal data of participants is collected, processed and used within the scope of the competition, this data will be collected, processed and used by CARADO exclusively for the purpose of carrying out the competition and will be deleted after the competition has ended. Further information on the processing of your data can be found in our information obligations pursuant to Art. 13 DSGVO. 

§ 8 Instagram notices and conditions

Entrants may not raise any objections against Instagram in connection with their use of the Competition app or participation in the Prize Draw. Entrants acknowledge that the Competition is in no way sponsored or organised by Instagram and is in no way affiliated with Instagram. All information and data communicated by or collected from entrants through the use of the Sweepstakes will be provided only to the Promoter and not to Instagram. All enquiries and notices regarding the Competition should be directed to the Promoter and not to Instagram.

Final provisions: 

• Should the conditions of participation contain invalid provisions, the validity of the remaining provisions shall remain unaffected.

• German law shall apply. Legal recourse to review the draw is excluded.

DATA PROTECTION NOTICE

Information requirements according to Art. 13 of the German Data Protection Regulation (DSGVO)

Carado GmbH is a company based in Germany and is the responsible party within the meaning of the DSGVO. The data you provide us with will be stored in our centralised customer database in Germany. 

Purposes and legal basis for the processing of your personal data. The collection and processing of personal data is based on the provisions of the Regulation on the Protection of Individuals with regard to the Processing of Personal Data (DSGVO). The legal basis for the processing of data in the context of the competition is based on Art. 6 para. 1 p. 1 lit. a) DSGVO. The personal data is collected, processed and used for the purposes of the competition. 

Data transfer within the group. Your data may be passed on within the group for administrative purposes. Should data be exchanged within the group, this will be done for the purpose of processing the competition or on the basis of your consent. In addition, there may be an interest in passing on this data for internal, administrative purposes. If your data is processed outside Europe, it will be transferred in compliance with all applicable data protection laws.

Data transfer to other recipients. Data will not be transferred to other recipients. If data is transferred to other recipients, this will only be done insofar as this is necessary for the processing of the prize. We use service providers who support us in the implementation of the competition. They act only on our instructions and process the data only for the specified purpose. Any further use does not take place and requires legal permission or consent.

Data transfer to a third country or an international organisation. Data will not be transferred to a third country or to an international organisation. This only takes place if suitable guarantees exist in accordance with Art. 44 ff. DSGVO.

Existence of automated decision-making including profiling. We do not use automated decision-making or profiling.

Storage period. After the competition has been carried out or after revocation of your consent, your data will be deleted, provided that there are no legal obligations to retain it.

Your rights. You have the right to free information about your stored personal data at any time, as well as the right to correction, data transferability and deletion of this data; if deletion is contrary to legal storage obligations, we will have this data blocked. You also have the right to object to the processing of this data or to demand that we restrict the processing. You also have the right to lodge a complaint with a supervisory authority. 

If the data processing is based on your consent, you can revoke this at any time for the future.
